5. Intellectual Property Rights

6.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

7. Indemnification

You agree to indemnify, defend, and hold harmless Summit Property Management, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

11.3 Effect of Termination

12. Governing Law and Jurisdiction

12.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of Croatia, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

12.3 EU Regulations

As Croatia is a member state of the European Union, applicable EU regulations and directives, including consumer protection laws and GDPR, shall apply where relevant.

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute arising from these Terms or your use of the Services, the parties agree to first attempt to resolve the dispute informally by contacting us at [email protected].

13.2 Mediation

If informal resolution is unsuccessful, the parties agree to attempt mediation before pursuing litigation. Mediation shall be conducted in accordance with Croatian mediation procedures.

13.3 Consumer Rights

If you are a consumer under Croatian or EU law, nothing in these Terms affects your mandatory statutory rights, including the right to pursue claims through small claims court or consumer protection agencies.

14. Force Majeure

Summit Property Management shall not be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15. Severability and Waiver

15.1 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.2 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Website, constitute the entire agreement between you and Summit Property Management regarding the use of our Services and supersede all prior agreements and understandings.

17. Changes to Terms
